Terms of Service

These terms govern your use of 4stage. By creating an account or using the service you agree to them. The service is operated by VijfDertien BV, registered in the Netherlands under KvK number 88208044, with registered office at Bouwstraat 21-5, 7483PE Haaksbergen, the Netherlands ("4stage", "we", "us").

1. The service

4stage is a band-management platform for working musicians. We provide it on a software- as-a-service basis. We may add, change, or remove features over time. We will give reasonable notice of changes that materially reduce functionality you actively rely on.

2. Your account

You must be at least 16 years old. You agree to provide accurate information and keep your login credentials secure. You are responsible for activity on your account. A band account may have multiple members; the band admin is responsible for inviting and removing members.

3. Acceptable use

You agree not to:

  • Use the service for unlawful purposes or in violation of others' rights.
  • Upload content that infringes intellectual property, is defamatory, or harmful.
  • Reverse engineer, scrape, or attempt to disrupt the service.
  • Resell, sublicense, or white-label the service except under a separate written agreement with us.
  • Use the service to send spam or unsolicited communications.

4. Free and paid tiers

The Free tier is offered indefinitely subject to usage limits described on the pricing page. The Plus tier is billed monthly or annually; a Pro tier is planned to launch alongside our native apps. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period.

For paid subscriptions, by completing checkout you acknowledge that you are purchasing access to digital content/services that we begin to provide to you immediately, and you expressly consent to immediate performance — which under Dutch consumer law (Art. 6:230o BW) means the 14-day right of withdrawal for digital services ceases to apply once performance has begun. Annual subscriptions are non-refundable except where mandatory consumer law requires otherwise.

5. Downgrades and account closure

If you downgrade to a tier with lower limits, content you have created remains in your account. The specific behaviour for content that exceeds the new tier's limits (for example, what becomes read-only or hidden) is described on the pricing page. We do not delete content on downgrade. If you close your account, we delete your data as described in the Privacy Policy.

6. Your content

You keep ownership of the content you upload (songs, setlists, recordings, photos, etc.). You grant us a worldwide, royalty-free licence to host, copy, transmit, and display your content solely to operate the service for you and your band. We do not sell or share your content with third parties for marketing.

7. Our IP

The 4stage name, logo, and software are owned by VijfDertien BV. Your subscription does not transfer any IP rights to you beyond the right to use the service.

8. Availability and "as-is"

We work hard to keep the service available and reliable, including offline gig mode for the moments where reliability matters most. To the maximum extent permitted by law, the service is provided "as-is" without warranties beyond those that cannot be excluded under mandatory consumer law.

9. Liability

To the extent permitted by law, our total liability for any claim arising from your use of the service is limited to direct damages and is capped at the fees you paid to us in the 12 months preceding the claim, or EUR 100 if you are on the Free tier. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption. This cap and these exclusions do not apply to liability that cannot be limited under mandatory Dutch law (e.g. intent or gross negligence).

10. Termination

You may stop using the service at any time. We may suspend or terminate access if you materially breach these terms; we will give reasonable notice except where immediate action is required to protect the service or other users.

11. Changes to these terms

We may update these terms. Material changes will be notified by email to registered users at least 30 days before they take effect. Continued use after the effective date means you accept the new terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in Amsterdam, without prejudice to your mandatory consumer rights.
